In areas where the ground is extremely dry and non-conductive, regardless of the # or depth rods are driven down, they run one wire or poly tape as ground the whole length of the fence and another wire a few inches below or above as the hot wire. In those instance, then yes a bird or rodent can be killed by coming in contact with both wires.
